DUI METABOLITE DEFENSE OVERVIEW

Most DUIs in Utah are given for driving under the influence of alcohol and/or drugs. However, Utah law also makes it illegal to drive with any trace of an illegal drug in your system. This means that even if you are no longer under the influence of any drug, if an illegal drug metabolite is found in your blood, and the police can show that you have been driving, you can be charged with DUI Metabolite. DUI Metabolite is usually classified as a class B misdemeanor, and the most common charges are for marijuana.

When a person uses any drug, his or her body will metabolize the drug quickly and the effects of the drug will typically wear off within a number of hours. However, even after the body processes the drug, left over molecules (metabolites) will remain in the body for days or weeks. For example, THC—the active ingredient in marijuana—will usually take less than an hour to leave the body, but THC metabolites can be detected in the blood for 10 to 13 days. If a person is driving during that time, he or she can be arrested for DUI metabolite.

DUI metabolite cases are very technical. A police officer must follow strict procedures for pulling you over, conducting the investigation, and obtaining a blood sample. Because the process must be closely followed in order to collect legal, untainted evidence, inexperienced or careless police will often make critical mistakes, and over-aggressive officers will often ignore constitutional rights during the process.
