NEGLIGENT HOMICIDE IN UTAH

Providing Serious Defense for a Serious Charge

Any situation in which a person dies unnecessarily is a serious matter. But not all such occurrences are criminal acts. Even though negligently causing the death of another person — such as in an automobile collision or other accident — may bring about civil liability as well as years of guilt, it will not necessarily lead to criminal charges unless the negligence involved reaches a certain level. But when it does reach that level, it becomes the crime of negligent homicide. If you have been found at fault for the death of another person, these or other criminal charges are a possibility. But contacting an experienced negligent homicide attorney in Utah early can help you recognize and protect your rights. At Intermountain Legal, we make it a priority to ensure our clients understand the process and their rights throughout. We keep them informed to minimize the stress and uncertainty they feel.

Utah Negligent Homicide

Utah law defines negligent homicide as acting with criminal negligence and thereby causing the death of another person. It is a Class A misdemeanor that can carry penalties of up to one year behind bars and up to $2,500 in fines. Moreover, when negligent homicide involves an automobile accident, the guilty party can have his or her driver’s license revoked. While not as serious as automobile homicide — which involves causing a death while driving under the influence and is at least a Class 2 felony — it is still a very serious matter deserving the attention of a skilled lawyer.

Distinguishing between simple negligence and a degree of criminal negligence that justifies a charge of negligent homicide is a very subjective and nuanced process — and a decision over which many prosecutors agonize. But it also presents a great deal of leeway for overly aggressive district attorneys to pursue criminal charges for conduct that many would view as a lapse of judgment that anyone could make. Many a person has been surprised to learn — while already dealing with the guilt and accompanying legal issues of causing the death of another — that they will also be facing criminal charges. Intermountain Legal has stepped up to help numerous people protect their rights in this difficult situation. Our attorneys work closely with prosecutors to reduce or dismiss these frequently unwarranted charges.
